SC gives relief to Virk, Punjab
will pursue case

CHANDIGARH:
The
Supreme Court has cleared S S Virk for posting in
Maharashtra,
vacating a stay by the High Court. On May 16, it upheld the validity
of Virk’s repatriation to
Maharashtra,
his parent cadre.
Punjab
Government has been going after the former DGP, first suspending him
and then pursuing cases of illegally gotten wealth against him. Now,
Punjab’s Advocate General H.S. Mattewal has said the state would
file a reply on May 31 on the Supreme Court order upholding the
validity of former Punjab DGP S.S. Virk’s repatriation to
Maharashtra.
The SC observed
that Virk could be given posting as DG in view of his repatriation
by the Central government through an order dated
April 10, 2007.
It said Virk had already joined the parent cadre following the order
issued by the Central government. The SC added that the order of the
Central government dated April 10 repatriating Virk to Maharashtra
would have to be given effect notwithstanding Punjab’s order of
suspension dated April 4.
The SC had
also observed that the High Court was not justified in staying the
CAT order validating Virk’s repatriation.
